General Conditions
Rental is subject to the provisions of these general conditions of sale which take precedence over any other document, unless otherwise expressly agreed with our company.
Any rental reservation implies unreserved acceptance by the buyer and full and complete adherence to these conditions.
Any document other than this one and in particular catalogues, prospectuses, advertisements, notices etc., has only an informative and indicative value, but not contractual.
Rental regulations
IDI Services SÃ rl will do everything in its power to ensure the smooth running of the service under the conditions provided for in the reservation.
In no case can IDI Services SÃ rl be held responsible or liable for any compensation or reimbursement in the event of modification of the itinerary, timetables, or duration of the itinerary due to force. major or instructions from the Police or Gendarmerie authorities.
Respecting Schedules
The fixed duration of the service starts from the meeting place, and stops when the customer leaves the vehicle at the end of the service.
Obligation of passengers
From the moment they are invited to board, each passenger must immediately and strictly comply with the instructions given by the driver in the interest of safety and order in the car and the journey.
IDI Services SÃ rl reserves the right to invoice the customer for any damage caused to the vehicle by themselves or by one of their guests.
It is prohibited for any person to sit behind the wheel of the vehicle or manipulate its controls.
Smoking is prohibited inside the vehicle.
Provision
As part of a provision, pricing is by the hour with a minimum of 2 hours.
Each hour includes 25 kilometers.
IDI Services SÃ rl reserves the right to charge additional kilometers at a rate of 3.5 chf if the total kilometers traveled exceed those guaranteed in the reservation.
Transfer
Transfer pricing is based on the distance traveled as well as the duration of the transfer.
IDI Services SÃ rl reserves the right to charge additional kilometers or overtime hours if the customer indicates a change to the reserved services agreed upon during their reservation.
IDI Services SÃ rl may decide to change the itinerary in the event of force majeure and subject to the sole validation of IDI Services SÃ rl but this will not modify invoicing.
Passenger liability
Each passenger (or if they are a minor, their parents or guardians) is responsible and undertakes to compensate IDI Services SÃ rl in accordance with the chapter, for any interior or exterior damage to the vehicle, as well as for any fine or fine due to an act, recklessness, omission or violation of a law, whether it is a voluntary act or not of the client or one of his guests.
Cancellation
Any modification or cancellation by the customer less than 24 hours before the reservation, whatever the reason, will be subject to fees in the amount as follows:
- Cancellation made 24 hours before the scheduled date:
- no rental penalty will be retained.
- Cancellation made less than 24 hours before the scheduled date:
- a penalty representing 25% of the rental reservation will be retained.
- Cancellation occurred less than 2 hours before (or after the departure of the car) or non-presentation of the customer on departure:
- a penalty representing 100% of the rental reservation will be retained.
Change of route and/or timetable
In the event of work on the scheduled route, demonstrations, accidents, weather hazards or for any other unforeseeable reason, IDI Services SÃ rl may at any time and after prior notification (if possible and as quickly as possible), modify the route or schedules.
The customer must be able to be reached by mobile phone and therefore provide their number on the contract.
Force majeure
In the event of force majeure (e.g. breakdown) making a vehicle unavailable, another vehicle may be made available if circumstances permit; only the share of this vehicle already paid will be reimbursed and no other request for compensation will be accepted.
In the event of a possible delay of any nature whatsoever, not attributable to the tenant, no recourse or compensation for the damage caused can be accepted.
An agreement can be reached, but the amount corresponding to the deposit is not refundable and can only be exchanged in the form of a voucher valid for a period of 12 months.
Personal items/Valuables/Baggage
Illicit or dangerous objects and products such as chemical, toxic, narcotic substances, firearms, explosives, oxygen, compressed air or flammable products, etc. are prohibited inside the vehicle.
IDI Services SÃ rl reserves the right to refuse a passenger possessing or wishing to introduce such products.
Any loss of objects, theft or material damage must be declared to the driver immediately.
Except in the event of negligence on its part, IDI Services SÃ rl cannot be held responsible for loss, theft, and/or damage to the passenger's property: clothing, hand luggage, valuables, equipment or floral decoration passengers.
Applicable Law
In the event of a dispute or dispute, the Swiss courts will have sole jurisdiction and only Swiss laws will apply.
The choice of domicile is made by our company, at its headquarters in Geneva.
Any dispute regarding the application of these general conditions of sale and their interpretation, their execution and the sales contracts concluded by our company, or the payment of the price, will be brought before the courts of the headquarters of our company.
The same applies to payment of the price, place of order, delivery, payment and method of payment, even in the event of a warranty claim or multiple defendants.
Bills of exchange do not constitute novation or derogation from this jurisdiction clause.
The attribution of jurisdiction is general and applies, whether it is a main request, an incidental request, an action on the merits or an interim order.
In addition, in the event of legal action or any other debt recovery action by our company, the summons and court costs, as well as lawyer and bailiff fees, and all related costs will be the responsibility of the customer at fault, as well as costs linked to or arising from non-compliance by the customer with the payment or delivery conditions of the order in question.
Private data
The information you provide to us is never entrusted to third parties.
We never use your contacts to send messages to potential business partners or mailing lists.
IDI Services SÃ rl undertakes not to communicate, free of charge or in exchange for compensation, the contact details of its customers to a third party.
Legal information
Providing personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the preparation of invoices and warranty contracts.
Failure to provide information results in non-validation of the order.
However, the customer has a right of access, modification, rectification and deletion of data concerning him and which he can exercise.
